Smith/Ballard vs. Wal-Mart Stores, Inc.
This proposed class action is currently pending in the United States District Court for the ral District of California. In it, our clients allege that Wal-Mart has consistently violated California Labor laws by failing to pay all accrued vacation time to terminating employees and has further failed to provide terminating employees with final paychecks in a timely manner. Berner vs. Kraft Foods, Inc.
Kraft Foods employs “merchandisers’ to stock the shelves in supermarkets and convenience stores with their products. While these employees are properly classified by Kraft Foods as hourly, non-exempt employees, they are required to do work at night for which they are not being paid. In addition, these employees frequently are not getting the meal and rest breaks they are entitled to. Ortega vs. AIG Insurance
This large insurance company has misclassified its adjusters in California who handle automobile claims as exempt employees who are not entitled to overtime compensation, despite the fact that California law is clearly to the contrary. This proposed class action is set in the United States District Court for the Central district of California. Labor Ready, Inc. provides temporary help to businesses throughout the country. This proposed class action, pending in the Los Angeles Superior Court, is brought on behalf of California employees who have not been paid the wages and benefits they are entitled to under the law. Duke vs. Avis
The proposed class action, pending in the Los Angeles Superior Court, seeks recovery on behalf of what Avis calls “independent” Avis location operators who, in reality, appear to be nothing more than employees who should have all of the rights and benefits of employees.
