Comtrak Logistics Class Action

This Class Action lawsuit alleges that Comtrak misclassified its truck drivers as independent contractors. Specifically, Plaintiffs allege that the control Comtrak exercises over the leased trucks and drivers day-to-day activities made these individuals “employees” under California law, therefore entitling them to the protections of the California labor code. As a result of this misclassification, Plaintiffs allege that Comtrak failed to provide its drivers all wages due, legally compliant meal and rest breaks, and Plaintiffs also seek civil penalties under California law.
