Hablian Workers’ Compensation Insurance Class Action
This proposed class action has been brought on behalf of individuals receiving workers’ compensation payments in California who allegedly have not been properly paid all sums that they are owed by the insurance carriers. Amongst other claims, this action seeks to recover unpaid penalties for payments that are made late, and interest thereon. Currently, this suit seeks recovery against Zurich U.S., State Compensation Ins. Fund, Liberty Mutual Ins. Co., Liberty Mutual Fire Ins. Co., Liberty Mutual Ins. Group, Lumberman’s Mutual Casualty Co., Kaiser Permanente Medical Group.
**Update as of 5/22/2017**
The Workers Compensation Judge (“WCJ”) denied petitioners’ Petition for Class Certification. Petitioners filed a Motion for Reconsideration, which was also denied by the WCJ. The case is now before the Workers Compensation Appeals Board, in San Francisco, for review of the WCJ’s decisions regarding the Petition for Class Certification.
